QDRO Corner

Qualified Domestic Relations Orders are one of the few exceptions to the rule that you can't pledge or otherwise encumber your interest in a pension plan, and your pension is not vulnerable to your creditors. A QDRO is a court order, usually in connection with divorce, that awards a specific portion of your pension benefits to your spouse and/or children. The problem is, many domestic relations orders are not "qualified" as drafted, and therefore can not be honored. The plan administrator has the responsibility to make the determination whether a DRO is qualified, and it's not always easy to tell a judge to "try again".

What if the DRO appears fraudulent?
